ABSTRACT:

In the Philippine Setting, there are three kinds of marriage settlements which are: Absolute Community of Property, Conjugal Partnership of Gains, and Complete Separation of Property. The latter two are mostly called pre-nuptial agreements and majority of the people think that it is an insult and shows distrust to a loved one while others say that one’s pre-nuptial agreement is usually entered into for purposes of convenience involving properties not the feelings of the spouses.

This study sought to determine the effects of Marriage Settlements on Spouses’ Marriage particularly in the City of Cauayan and the Municipalities of Cabatuan and San Mariano, Isabela. This study focused to determine the reasons why the respondents entered into their chosen marriage settlements; the advantages and disadvantages of having it; the stigma they experienced having it; the strategies they are making or doing to balance their love and wealth; and the effects of it to their marriages using the Qualitative Descriptive Research Method. There are a total of eight (8) respondent spouses in this study. After the data was gathered from the respondents using a face-to-face interview, it was transcribed, analyzed, and interpreted by the researcher. It was found that the Absolute Community of Properties kind of marriage settlement has more positive effects on marriage than the Conjugal Partnership of Gains and Complete Separation of Properties.
